We provide consultation regarding the suitability of objects to be protected as designs and the appropriate type of registration. Plain and three-dimensional shapes can – depending on the requirements
for protection – be a design or alternatively a device or form mark. Whereas the (threedimensional) trademark shall distinguish goods and/or services of enterprises from such of others, the design
protects the appearance and the shape of a product. | | | Designs which in the overall impression are similar to a prior
registered design can be disputed. A design can be protected if it is new at the time of the filing and shows a certain unique nature. Both of these protection requirements are not, however, checked
during the registration process. | | | Series filings of designs are possible within the same application, if they are
associated with the same Locarno class. A design must be filed as an image in reproducible form (photo or illustration). For the purpose of a temporary nondisclosure the publication of a design can be
postponed, for a maximum duration of 30 months. The design registration can be extended four times to a period of 5 years each time, for a total duration of 25 years. | | |
